It is an offence to place or retain a temporary dwelling on a national road, motorway, busway or protected road including the margins, kerbs, lay-bys and hard shoulders of the road. The road authority may arrange for the removal and storage of such vehicles and serve a notice on the owner stating where the temporary dwelling may be recovered within one month. The use of unauthorised signs, unauthorised caravans or vehicles for advertising the sale of goods or the provision of services on public roads is also prohibited. The Council and the Gardai are empowered to remove these structures and serve a notice on the owner stating where the structure may be recovered within one month. A local authority is entitled to recover expenses incurred in preventing and removing obstructions on a public road under its management.
